Criminal Probe Into Anna's Prescriptions

TMZ has learned the California Department of Justice (DOJ) is conducting a criminal investigation into several doctors who prescribed various medicines to Anna Nicole Smith.

Sources tell TMZ the DOJ's Bureau of Narcotics Enforcement has contacted Larry Birkhead, Big Mo (Anna's bodyguard) and others. We're told DOJ is particularly interested in two doctors -- Khristine Eroshevich and Sandeep Kapoor. TMZ broke the story that Dr. Kapoor prescribed methadone to Anna under an assumed name when she was eight months pregnant. Dr. Eroshevich ordered a virtual pharmacy of drugs for Anna, five days after her son Daniel died.

Dr. Eroshevich, who was in the Bahamas with Anna, sent the prescription wish list to Dr. Kapoor. Kapoor's attorney, Ellyn Garofalo, told TMZ "Dr. Kapoor declined the request for prescriptions. He would never prescribe that combination of drugs, in such large dosages, to any patient."

The Medical Board of California launched its own investigation of the two doctors earlier this year. That investigation is pending.

By the way, TMZ has learned Dr. Kapoor is in the process of having twins via a surrogate.

Looks like O'Quinn should have NO problem showing up due to health. Perfectly capable of supporting Rita's book.

Entertainment Tonight IS part of CBS. LMAO at TSG trying to boycott them. Seems to me that all the news/gossip sites are discussing Rita getting served vs the 'book signing'. JE attempted to get ET to come in and "get a 'great spot' to catch all the action." HKS rained on their parade and that is more newsworthy than the 'book signing'. Still LMAO.

31270. There is generally no need to cite case law in your initial filing - just the facts.

O'Quinn argued he was not working or living in FL, just dropped into that State to defame HKS for purposes of media coverage. The Judge didn't buy it. Case for the Jury in FL.

Wood's filing v. Cosby/Hachette Book Group is crisp and clean and straight-forward and a bombshell. Every 'source' dissected as not credible, every alleged action/crime desemated with the facts.

Oh, okay. The first filing is just a "notice of suit," then? It doesn't need to have all the details (as you say it, citation of case law, etc.)? I just thought neither suit "read" like a formal suit.

But then occurred to me, That's what the trial is for. The lawsuit may read, "The Defendant says HKS did this. The Defendant is lying. HKS did not do this, but we don't have to explain it here how we can prove he did not do it. We will prove it at the trial."

The law works a lot like a mathematical equation, where arguments must be presented in language that reads logically--i.e., A plus B equals C, and X plus A equals Z; therefore B plus Y equals C.

I think most lay persons call all that logical argument "mumbo jumbo."

When a judge weighs the merits of the suit, however, he determines its standing based on its logical arguments. I see none of those kinds of arguments in either of Lin's suits. He presents all the "therefores," without any of the logical arguments to show how his therefores were arrived at.

Without all the mumbo jumbo, the suit is a much friendlier read, for the public at large to enjoy.

So that's why I was asking earlier as to whether a more formal version of the suit would be coming down the pike. I'm not an expert in law and I have never been involved in the drafting and presenting of legal docs. But I have seen my share and they are very tight and precise.
